Terms of Service

These Terms apply to Smez and the services that help creators and teams prepare, publish, and monitor short-form video content.
1. Agreement to These Terms
These Terms of Service govern your access to and use of Smez, available at smez.co and related Smez-controlled domains.
By creating an account, connecting a platform account, uploading content, or using Smez, you agree to these Terms.
2. The Service
Smez is a creator operations app that helps users upload source media, generate edit plans, render short-form videos, prepare captions and metadata, schedule content, and publish to connected third-party platforms where supported.
Smez may be offered as a private beta. Features, availability, quotas, pricing, and platform integrations may change over time.
3. Accounts and Workspaces
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. You must provide accurate information and keep it up to date.
Workspace owners and admins control workspace membership, permissions, connected platform accounts, and workspace content. If you join a workspace, your activity may be visible to other authorized workspace members.
4. Connected Platform Accounts
You may connect third-party platform accounts, including TikTok, Instagram, and YouTube, using OAuth or another approved authorization method. You authorize Smez to use the permissions you grant for the purpose of providing the service.
You are responsible for ensuring that you have the right to connect each account and publish, manage, or monitor content through that account.
Your use of TikTok, Instagram, YouTube, and any other third-party platform remains subject to that platform provider's own terms, policies, developer rules, content guidelines, and API restrictions.
5. Publishing Content
Smez will publish content only through connected accounts and workflows you initiate or configure. You are responsible for reviewing videos, captions, hashtags, settings, and schedules before publishing.
Platforms may reject, delay, remove, restrict, or alter content or publishing behavior. Smez is not responsible for platform moderation decisions, API outages, quota limits, audit requirements, or changes to third-party platform policies.
For TikTok, unaudited or unapproved API clients may be restricted to private posting or other limited behavior until TikTok approves the relevant app and permissions.
6. Your Content
You retain ownership of content you upload or create in Smez. You grant Smez a limited license to host, store, copy, process, transcode, analyze, render, display, and transmit your content as needed to provide and improve the service.
You represent that you have all rights needed to upload, process, publish, and authorize Smez to use your content, including any rights in music, images, video, voices, likenesses, brands, and other materials.
7. Acceptable Use
You may not use Smez to violate laws, infringe rights, bypass platform rules, distribute malware, abuse APIs, scrape data without authorization, interfere with the service, or upload or publish unlawful, deceptive, harmful, or infringing content.
You may not reverse engineer, resell, or misuse Smez except as permitted by law or by a written agreement with Smez.
8. Beta Features and Availability
Some Smez features may be experimental, incomplete, or available only to selected users. We may modify, suspend, or discontinue features at any time.
We try to keep Smez reliable, but we do not guarantee uninterrupted access, successful publishing, continuous platform API availability, or error-free generated outputs.
9. Fees
If paid plans, usage limits, or billing features are enabled, you agree to pay the applicable fees and taxes. Any specific payment terms presented at checkout or in an order form will also apply.
10. Termination
You may stop using Smez at any time. We may suspend or terminate access if you violate these Terms, create risk for Smez or others, fail to pay fees, or if continued service is no longer commercially or legally practical.
11. Disclaimers
Smez is provided as is and as available. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12. Limitation of Liability
To the fullest extent permitted by law, Smez will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, lost revenue, platform account actions, or business interruption.
13. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users through Smez or other appropriate channels. Continued use of Smez after changes take effect means you accept the updated Terms.
